Article 3 Changes in other laws


Article 3 is quoted in 13 regulations and changes with wwv. 1.
Section 11 is amended as follows:

a)
The following sentence is added to paragraph 1:

"Representation by representatives of the associations named in Section 23 of the General Equal Treatment Act is also permitted when asserting a right due to a violation of the prohibition of discrimination in accordance with Section 7 (1) of the General Equal Treatment Act, if these persons are authorized to represent them by virtue of their articles of association or power of attorney. "

b)
In paragraph 3, sentence 2, the information "sentences 2 to 5" is replaced by the information "sentences 2 to 6".

Section 61b is amended as follows:

a)
The heading is worded as follows:

"Section 61b action for discrimination".

b)
Paragraph 1 is worded as follows:

"(1) An action for compensation according to § 15 of the General Equal Treatment Act must be filed within three months after the claim has been made in writing."

c)
In Paragraph 2 Clause 1, the phrase "in accordance with Section 611a Paragraph 2 of the Civil Code" is replaced by the phrase "in accordance with Section 15 of the General Equal Treatment Act".


(3) Section 75 (1) of the Works Constitution Act in the version published on September 25, 2001 (Federal Law Gazette I p. 2518), last amended by Article 5 No. 2 of the Act of May 18, 2004 (Federal Law Gazette I p. 974) is amended as follows:

 
"(1) The employer and works council must ensure that all persons working in the company are treated according to the principles of law and equity, in particular that any discrimination against people on the basis of their race or their ethnic origin, their descent or other origin , their nationality, their religion or belief, their disability, their age, their political or trade union activities or attitudes or because of their gender or their sexual identity. "

(4) Section 67 (1) sentence 1 of the Federal Personnel Representation Act of March 15, 1974 (Federal Law Gazette I p. 693), which was last amended by Article 8 of the Act of September 14, 2005 (Federal Law Gazette I p. 2746), is formulated as follows:

 
"The agency and the staff representatives have to ensure that all members of the agency are treated in accordance with the law and equality, in particular that any discrimination against people on the basis of their race or ethnic origin, their descent or other origin, their nationality, their religion or Ideology, their disability, their age, their political or trade union activities or attitudes or because of their gender or their sexual identity is omitted. "


 
"(1) The applicants are to be identified through a job advertisement. They are selected based on suitability, ability and professional performance regardless of gender, origin, race or ethnic origin, disability, religion or belief, political views, origin, relationships or sexual identity. This is not opposed by legal measures to promote civil servants to enforce actual equality in working life, in particular quota regulations with individual checks, as well as legal measures to promote severely disabled people. "

(6) Section 27 (1) of the Speaker Committee Act of December 20, 1988 (Federal Law Gazette I, p. 2312, 2316), which was last amended by Article 174 of the Ordinance of November 25, 2003 (Federal Law Gazette I, p. 2304), is formulated as follows:

 
“(1) Employers and the committee of speakers have to ensure that all executive employees of the company are treated according to the principles of law and equity, in particular that any discrimination against people on the basis of their race or their ethnic origin, their descent or other origin , their nationality, their religion or belief, their disability, their age, their political or trade union activities or attitudes or because of their gender or their sexual identity. "

In section 36, sentence 3, the words "protection against discrimination in employment and occupation" are inserted after the words "occupational health and safety".

Section 81 (2) sentence 2 is worded as follows:

"In detail, the regulations of the General Equal Treatment Act apply."

§ 5 is changed as follows:

a)
Paragraph 2 is repealed.

b)
The paragraph designation "(1)" is deleted.

In Section 19, Paragraph 1, Clause 1, the words "of the Employment Protection Act" are replaced by the words "of the General Equal Treatment Act with regard to protection against discrimination due to gender and sexual harassment".


 
"(1) The soldier is to be appointed and used according to suitability, ability and performance regardless of gender, sexual identity, origin, race, belief, worldview, religious or political beliefs, homeland, ethnic or other origin."


 
"Section 157 (1) of the Code of Civil Procedure also does not apply to members and employees of the associations named in Section 23 (1) of the General Equal Treatment Act who act as agents of those involved within the framework of the association's statutory purpose. The associations named in sentence 5 are permitted to deal with legal matters of those involved within the scope of their statutory purpose. "

§ 4 is changed as follows:

a)
Paragraph 6 sentence 1 is worded as follows:

"There is direct discrimination against women soldiers if, on the basis of their gender, they are treated less favorably than soldiers in a comparable situation, have experienced, or would have experienced."

b)
Paragraph 7 is repealed.

Section 5 (2) is worded as follows:

"(2) In the event of violations by the agencies of the prohibitions on discrimination when establishing an employment relationship and during career advancement, Section 12 of the Soldiers' Equal Treatment Act applies."

Section 16 is amended as follows:

a)
In paragraph 5, sentence 1, the item "3" is replaced by the item "4".

b)
Paragraph 8 sentence 2 is worded as follows:

"You are not allowed to be a person of trust under the Soldiers' Participation Act or belong to a representative body for the severely disabled."

c)
Paragraph 10 is amended as follows:

aa)
In sentence 3, after the word “to be”, the words “, whereby one honorary judge must be a non-commissioned officer, the other honorary judge must be a staff officer”.

bb)
Sentence 4 is worded as follows:

“The order in which they are called is based on the uniform list of honorary judges for proceedings under this law, in which the various branches of the armed forces are to be adequately taken into account; Section 74 (8) of the Defense Disciplinary Code applies accordingly. "

d)
Paragraph 11 sentence 2 is worded as follows: "Paragraph 10 applies accordingly."

e)
In paragraph 12, "2" is replaced by "1".

4.
Section 19 (1) sentence 1 is worded as follows:

“The equal opportunities officer has to promote and support the implementation of this law in the department; this also applies to the Soldiers' Equal Treatment Act with regard to the prohibition of discrimination based on gender in the form of harassment and sexual harassment. "
